Age Verification & Underage Policy
CallBae (callbae.com)
Effective Date: March 10, 2026
Last Updated: March 10, 2026
Overview
CallBae is an adults-only AI companion platform. You must be 18 years of age or older to access, register for, or use CallBae in any capacity. There are no exceptions.
All AI-generated content on CallBae — including text, images, audio, and video — is intended exclusively for adult users. We maintain a zero-tolerance policy for underage access and take aggressive measures to prevent minors from using our platform.
This policy describes how we verify user age, what happens when an underage user is detected, how we comply with applicable federal and state laws, and how we handle age verification data.
1. Age Verification — Phased Approach
Phase 1: Age Gate at Registration (Current)
All users must complete the following before accessing any content on CallBae:
- Date of Birth Entry: Users must enter their full date of birth (month, day, year). The system calculates age in real time and blocks registration for anyone under 18.
- Affirmative Checkbox Confirmation: Users must check a box confirming: "I am at least 18 years old and I understand that CallBae contains adult content not suitable for minors. I confirm that providing false age information is a violation of these Terms of Service and may be a violation of applicable law."
- Terms Acknowledgment: Users must accept the Terms of Service and this Age Verification & Underage Policy before account creation.
- Failed Verification: If a user enters a date of birth indicating they are under 18, they are immediately blocked from registration. The attempt is logged, and access from that device/browser is restricted for 24 hours.
Important: Providing false age information constitutes a material violation of our Terms of Service and may result in permanent account termination and forfeiture of any credits or payments.
Phase 2: Government ID Verification (Planned)
Upon reaching 5 paying customers, CallBae will implement mandatory real-identity age verification through a certified third-party provider. We are evaluating the following providers:
| Provider | Method | Compliance |
|----------|--------|------------|
| Yoti | Digital ID, facial age estimation | UK Age Check Certification, GDPR compliant |
| Jumio | Government ID scan + biometric selfie | SOC 2 Type II, PCI DSS |
| AgeChecked | ID document verification, database checks | UK AVMS compliant |
Phase 2 verification will require:
- Upload of a valid government-issued photo ID (driver's license, passport, or state ID)
- A live selfie for biometric matching against the ID
- Real-time age calculation from the ID's date of birth
- Verification must be completed before any NSFW content is accessible
ID verification data handling is addressed in Section 7 below.
2. State Age Verification Law Compliance
As of March 2026, 27 US states have enacted laws requiring age verification for platforms containing adult content. CallBae complies with all applicable state age verification requirements.
States with Age Verification Laws in Effect
| State | Law | Effective |
|-------|-----|-----------|
| Alabama | HB 164 | Oct 1, 2024 |
| Arizona | HB 2112 | Sep 26, 2025 |
| Arkansas | Act 689 | Jul 31, 2023 |
| Florida | HB 3 | Jan 1, 2025 |
| Georgia | SB 351 | Jul 1, 2025 |
| Idaho | H 498 | Jul 1, 2024 |
| Indiana | SEA 17 | Jul 1, 2024 |
| Kansas | HB 2592 | Jul 1, 2024 |
| Kentucky | HB 278 | Jul 15, 2024 |
| Louisiana | Act 440 | Jan 1, 2023 |
| Mississippi | SB 2346 | Jul 1, 2023 |
| Missouri | 15 CSR 60-17.010 | Nov 30, 2025 |

| North Carolina | HB 8 | Jan 1, 2024 |
| North Dakota | HB 1561 / SB 2380 | Aug 1, 2025 |
| Ohio | HB 96 (Innocence Act) | Sep 30, 2025 |
| Oklahoma | SB 1959 | Nov 1, 2024 |
| South Carolina | Child Online Safety Act | Jan 1, 2025 |
| South Dakota | HB 1053 | Jul 1, 2025 |
| Tennessee | HB 1891 | Jan 1, 2025 |
| Texas | HB 1181 | Sep 1, 2023 |
| Utah | SB 287 | May 3, 2023 |
| Virginia | HB 1581 | Jul 1, 2023 |
| Wyoming | HB 43 | Jul 1, 2025 |
For users in these states: CallBae implements the strongest applicable verification standard. When Phase 2 ID verification is live, all users in jurisdictions requiring government-ID-level verification will be routed through the third-party verification process before accessing any content.
We actively monitor state legislatures and will update this policy as new laws take effect.
3. COPPA Compliance (Users Under 13)
CallBae fully complies with the Children's Online Privacy Protection Act (COPPA).
- Absolute prohibition: Users under 13 may not access CallBae under any circumstances.
- No data collection: We do not knowingly collect, use, store, or disclose personal information from anyone under 13.
- Immediate deletion: If we discover that any personal information has been collected from a child under 13, we will delete it immediately and permanently — including all account data, conversation history, and associated records.
- No parental consent workaround: Unlike platforms that allow parental consent for users under 13, CallBae does not. Our platform contains AI-generated adult content that is categorically inappropriate for children. There is no consent mechanism that makes this acceptable.
4. California SB 243 Compliance (AI Companion Chatbot Law)
CallBae complies with California Senate Bill 243 (effective January 1, 2026), which establishes safety requirements for AI companion chatbot platforms.
4.1 AI Disclosure Requirement
- All users are informed clearly and conspicuously that they are interacting with artificial intelligence, not a human being.
- This disclosure appears:
- During onboarding/registration
- On every companion profile page
- In the chat interface (persistent notice)
- In our Terms of Service
4.2 Minor Detection & Response
CallBae is an 18+ platform and does not knowingly serve minors. However, if we detect or reasonably believe that a user is a minor:
- All NSFW content is immediately blocked for that account
- AI disclosure notifications are sent at least every 3 hours during any continuing interaction, reminding the user that the chatbot is AI-generated and encouraging them to take a break
- Account is flagged for review and escalation (see Section 5)
- Suitability warning is displayed: "CallBae's AI companions may not be suitable for some minors."
4.3 Crisis Response Protocol
CallBae maintains a published crisis prevention protocol:
- Content filtering: Our AI systems are programmed to detect and refuse to generate content related to suicidal ideation, self-harm, or encouragement of dangerous behavior.
- Crisis referrals: When a user expresses suicidal ideation, self-harm intent, or acute distress, the system immediately:
- Pauses the AI companion response
- Displays a crisis intervention notice with direct links to:
- 988 Suicide & Crisis Lifeline: Call or text 988
- Crisis Text Line: Text HOME to 741741
- National Domestic Violence Hotline: 1-800-799-7233
- Logs the event for safety review (without exposing conversation content to staff unless legally required)
- Evidence-based methods: We use evidence-based screening approaches aligned with clinical standards for detecting suicidal ideation.
4.4 Annual Reporting
Beginning July 1, 2027, CallBae will submit annual reports to the California Department of Public Health's Office of Suicide Prevention detailing:
- Number of crisis referral notifications issued
- Protocols for detecting and responding to suicidal ideation
- Protocols for preventing AI-generated content related to self-harm
5. Underage User Detection & Enforcement
How We Detect Underage Users
- Registration screening: Date of birth entry blocks users under 18
- Behavioral signals: Our systems monitor for behavioral patterns that may indicate a minor is using the platform (e.g., language patterns, stated age in conversations)
- User reports: Any user can report a suspected underage account via [email protected]
- Payment verification: Credit card and payment information may provide additional age signals
- Phase 2 ID verification: Government ID verification will provide definitive age confirmation
What Happens When an Underage User Is Detected
When we determine or reasonably believe a user is under 18, we take immediate and irreversible action:
- Immediate account suspension — all access is terminated instantly
- Content blocking — all NSFW content is blocked before suspension takes effect
- Full data deletion — all personal data, conversation history, AI companion configurations, uploaded media, and any other user-generated content is permanently deleted within 72 hours
- Payment refunds — any active subscription or token balance is refunded (we do not profit from underage access)
- Device/IP logging — the device fingerprint and IP address are logged to prevent re-registration
- Incident documentation — the detection event is logged internally for compliance records (without retaining the minor's personal data)
There is no appeal process for underage users. The account is gone. The data is gone.
Re-registration Prevention
- Users who were terminated for being underage may not create a new account until they can verify they are 18+ through Phase 2 ID verification
- Attempts to circumvent this block (VPN, new email, etc.) constitute further violations and may be reported to appropriate authorities
6. Parental Notification
If we determine that an underage user has accessed CallBae:
- If parental contact information is available (e.g., the minor provided a parent's email, or a parent contacts us), we will notify the parent/guardian of:
- The fact that their child accessed an adults-only platform
- What data was collected and that it has been deleted
- Resources for online safety (including the Family Online Safety Institute and NetSmartz)
- If parental contact information is not available, we will still:
- Terminate the account and delete all data
- Retain a record of the incident for compliance purposes
- Cooperate with any parent/guardian who contacts us after the fact
Parents/guardians who believe their child has accessed CallBae should contact us immediately at [email protected]. We will prioritize these reports and respond within 24 hours.
7. Age Verification Data Handling
We take the privacy of age verification data extremely seriously. Our principle is: verify, then delete.
Phase 1 (Date of Birth)
- Date of birth is collected at registration and stored as part of the user profile
- It is used solely for age verification and legal compliance
- It is not shared with third parties except as required by law
Phase 2 (Government ID Verification)
When Phase 2 is implemented:
- Collection: Government ID images and biometric selfie data are transmitted directly to our third-party verification provider via encrypted channels
- Verification: The provider verifies age and identity, then returns a pass/fail result to CallBae
- Deletion: CallBae does not store government ID images, ID numbers, or biometric data. The third-party provider processes and deletes this data according to their privacy policy and applicable data retention laws
- What we store: Only the verification result (pass/fail), the date of verification, and the provider used — no raw ID data
- Re-verification: If re-verification is required (e.g., account recovery), users must complete the ID verification process again from scratch
Data Retention Summary
| Data Type | Stored By CallBae? | Retention Period |
|-----------|-------------------|------------------|
| Date of birth | Yes | Duration of account |
| Government ID images | No | Not retained |
| Biometric selfie data | No | Not retained |
| Verification result (pass/fail) | Yes | Duration of account |
| Verification provider name | Yes | Duration of account |
| Date of verification | Yes | Duration of account |
8. CSAM Reporting — Mandatory Obligations
CallBae maintains a zero-tolerance policy for Child Sexual Abuse Material (CSAM).
What Constitutes CSAM
Any visual depiction — including AI-generated images, videos, or other media — that depicts a minor engaged in sexually explicit conduct, or that is indistinguishable from such a depiction, is CSAM under federal law (18 U.S.C. §§ 2256, 2252A).
Our Obligations
- Mandatory reporting: Under 18 U.S.C. § 2258A, CallBae is required to report any apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline.
- Preservation: Upon detection, we preserve all relevant data and evidence for 90 days (or longer if requested by law enforcement) as required by 18 U.S.C. § 2258A.
- Cooperation: We fully cooperate with NCMEC, the FBI, the Department of Justice, and any state or local law enforcement agency investigating CSAM.
- Content moderation: Our AI systems include content filters designed to prevent the generation of any content depicting or resembling minors in sexual situations. Attempts to circumvent these filters are logged and may trigger a NCMEC report.
User Reporting
If you encounter any content on CallBae that you believe constitutes CSAM or depicts a minor:
- Report immediately to [email protected]
- You may also report directly to NCMEC at [www.missingkids.org/gethelpnow/cybertipline](https://www.missingkids.org/gethelpnow/cybertipline)
Attempting to generate, distribute, or possess CSAM — including AI-generated CSAM — is a federal crime punishable by imprisonment.
9. AI-Generated Content Safeguards
Beyond age verification, CallBae implements the following safeguards to prevent AI-generated content from involving minors:
- Prompt filtering: All user prompts are screened for attempts to generate content involving minors, and such requests are blocked and logged
- Character age enforcement: All AI companions on CallBae are designed and presented as adults (18+). Users cannot create, modify, or request companions that appear to be or are described as under 18
- Image generation guardrails: Any image generation features include filters to prevent output that depicts or resembles minors
- Continuous monitoring: We regularly audit our AI models and content moderation systems to identify and close potential bypass vectors
10. Contact Information

11. Policy Updates
CallBae reserves the right to update this policy at any time to reflect changes in applicable law, industry best practices, or our own safety standards. Material changes will be communicated to registered users via email and/or in-app notification. Continued use of CallBae after changes take effect constitutes acceptance of the updated policy.
This policy is part of CallBae's commitment to operating a responsible, legally compliant, adults-only platform. We take the safety of minors seriously — not as a checkbox exercise, but as a fundamental obligation.
